SPECIAL MEETING

Reopened the meeting to discuss the strategy we should take regarding the MPCA and SRWD.
Tom Klemenhagen and Ken Weber were in attendance to get Atty. William Peterson up dated and explain some of the procedures which were taken.
Klemenhagen and Weber asked the Attorney if the SRWD had the authority to issue fines etc. to the City of Osakis?
Our Attorney William Peterson stated he though that we should go ahead with the law suit against SRWD, and that it was filed at Todd County and no court date has been set as of yet, they have 13 months from date of filing to comply.
Klemenhagen stated that when we proceed with Osakis Properties phase II, that there will have to be a pond put in the development. A Permit will have to be filed for on that project also.
John Timmerman left the meeting at 12:25 pm but before he left he wanted to put out on the table the East Pond issue. He wanted to know who was obligated to pay and a time table.
Motion was made and seconded to have Mr. Klemenhagen prepare a submittal to all the violations that the SRWD covered in the Certified letter which the Mayor and City Clerk received on September 9, 2003
The City Clerk is to contact somebody to receive a copy of the minutes of the SRWD meetings for the last year.
The Mayor and Mr. Peterson will be in attendance at the meeting set up on September 16th, 2003 between MPCA, SRWD, MnDOT, Duininck Bros. and Landteam.
Mayor Astleford is to get in contact with Dallas Sams to see if he and Atty. Peterson could meet with him at his earliest convenience.
Klemenhagen and Weber asked the Attorney what if anything kind of fines etc could the SRWD do against the City of Osakis.
East pond was discussed and a motion by Hagemann seconded by Emerson to purchase the land from Jerry Olson for $4,000.00 and to go ahead and open the bids on September 23, 2003. All Ayes, Timmerman absent
Motion by Emerson seconded by Hagemann to adjourn. Meeting adjourned at 1:00 PM. All Ayes, Timmerman absent.
