SPECIAL MEETING

OSAKIS CITY COUNCIL

MAY 20, 2002

6:00 PM 

Mayor Zimmerman called the meeting to order. 

Present:  Hagemann, Zimmerman, Larson, Astleford 

Absent:  Emerson  

The Council reviewed the Sauk River Watershed District Permit No. 02-03. 

After discussion the following Resolution was presented by Astleford seconded by Hagemann. 

RESOLUTION

SAUK RIVER WATERSHED PERMIT 

WHEREAS: Minnesota Department of Transportation Cooperative Agreement Policy defines MnDOTS cost share of storm water treatment based on the contributing drainage area.  MnDOT’s Contributing Drainage Area is insignificant.  The City of Osakis will assume responsibility for storm water treatment issues relating to the proposed Trunk Highway # 27 storm sewer within the corporate limits. 

WHEREAS: City representatives met with the watershed district on April 2, 2002, and presented their plan to mitigate the potentially adverse water quality impacts of the proposed storm sewer enlargement.  The district agreed in principle with what was proposed, subject to technical review by their engineering consultant. 

WHEREAS: the district’s engineering consultant approved the plan, as subsequently modified by the city. 

WHEREAS:  At the district’s meeting on May 15th, a proposed permit was brought to the table that differed greatly from the previous agreement and would place additional burdens on the city.  The city was cut short in discussing its concerns about the conditions included in the proposed permit.  The permit was issued as proposed. 

WHEREAS:  Because permit deliberation extended to a critical time for the project the city has no opportunity to challenge the District’s decision without seriously delaying project construction. 

NOW THEREFORE BE IT RESOLVED: The city accepts the permit agreeing to be bound only by those conditions that the watershed district has a legitimate and legal right to demand as a condition of the permit applied for.

When put to a vote the Resolution passed unanimously.  Emerson absent. 

Tom Klemenhagen, Engineering Representative,, has reviewed and tabulated the bids received on the State Highway 27 Project.  MnDOT concurs that the bid should be awarded to the low bidder, Duininck Bro’s. Inc. 

A Resolution was presented by Hagemann seconded by Larson to accept and award the bid to Duininck Bro’s Inc., Construction Company of Prinsburg, Mn., with a bid of $4,188,463.05.  When put to a vote the Resolution passed unanimously.  Emerson absent. 

The Council discussed the petition the city presented to the Sauk River Watershed months earlier to divert water south of Osakis before entering the city. 

A motion by Astleford seconded by Hagemann to rescind this petition.  All Ayes.

Emerson absent. 

By unanimous consent the Council requested Mr. Klemenhagen to contact Charles Anderson to recommend an attorney to help with the Sauk River Watershed Permit stipulation. 

When the necessary paper work is complete MnDOT will disburse approximately $4,000,000.00.  In view of this large amount of money a Resolution was presented by Astleford seconded by Larson authorizing entry into joint powers agreement in the form of a declaration of trust establishing an entity known as “Minnesota Municipal Money market Fund” and authorizing participation in certain investment programs.  When put to a vote the resolution passed unanimously.  Emerson absent. 

With the large number of construction workers needing lodging, a motion was made by Hagemann seconded by Larson to allow temporary construction workers housing (small camper trailers etc) one rental unit per parcel for the 2002 year.  All Ayes. Emerson absent. 

A motion by Larson seconded by Hagemann to continue this meeting to Wednesday May 22, 2002 at 7:00 pm.  All Ayes, Emerson absent. 

Meeting recessed. 6:55 PM.
