Mayor Zimmerman called the Public Hearing to order.

Present: Hagemann, Larson, Zimmerman, Emerson, Astleford

Absent: None

Project # 275 –Oak & Pike Street Project

A motion by Astleford seconded by Hagemann to open the public hearing to consider the assessment roll for the Oak, Pike, 3rd Ave. W. and 1st Avenue West improvements. All Ayes

The sign in sheet shows 52 residents in attendance.

The Mayor turned the meeting over to Tom Klemenhagen representing Stahlberg Nyberg and Associates.

Mr. Klemenhagen presented an overall review of the project. He explained the assessment policy percentages and how they affect all the abutting/ and or benefiting property owners. He included project cost and assessment cost. The meeting was then open for questions.

Everyone in attendance had an opportunity to be heard.

A motion by Hagemann seconded by Larson to close the public hearing. All Ayes.

A petition was received stating residents signing oppose all assessments for streets, sanitary sewer, water, storm sewer and sidewalks. “We believe the assessments are unfair as this is definitely a city project” The petition has 71 signatures.

Dana Hetland requested the council read the signatures, Councilmember Emerson read the list.

Two years ago the council felt the best way to finance part of the project was by assessments for abutting and/or benefiting property owners.

Therefore, a motion by Emerson seconded by Hagemann to decline consideration of the petition presented. All Ayes

At this time Frank Nelson asked several questions about having discussion before council votes and additional questiones some councilmembers felt were already answered.

Councilmember Emerson stated Mr. Nelson was an impolite jerk and Mr. Nelson wanted this recorded in the minutes.

A letter was received from Marlyn Amsler objecting, to his special assessments. Concerns were curb and gutter and sidewalk just put in 1999, also if water & sewer services required on a lot only 6,120 square feet.

A motion by Hagemann seconded by Larson to review Mr. Amsler’s assessment before finalizing. All Ayes.

A letter was received from the First Presbyterian Church.

Mr. Richard Roberts was in attendance and stated they had no objection to the manner in which the assessments were figures, and no technical problems. They are objecting on grounds of material prejudice.

Mr. Roberts requested the council to reduce assessments for all churchs.

A motion by Larson seconded by Emerson to leave assessments as presented.

After discussion on the services provided for the Presbyterian Church, Larson recinded his motion and Emerson recinded his second.

A motion by Larson seconded by Hagemann to review the service charged before finalizing the assessment. All Ayes.

A letter was received from John Stigman objecting to his assessments. He was in attendance and stated his objection is having to pay 30% of the street cost, feels it’s a public street and the public should bear the cost.

A motion by Astleford seconded by Emerson to leave assessments as presented. After discussion the vote was Astleford, Emerson, Zimmerman, Hagemann Aye, Larson Nay.

A letter was received from Vicki Hinrich objection to the amount of her assessment..

A motion by Emerson seconded by Hagemann to leave assessment as presented. After discussion the vote was Astleford, Emerson, Zimmerman, Hagemann Aye, Larson Nay.

A letter was received from Frank Nelson objecting to his assessments.

Mr. Nelson was assessed for an extra sewer service and 90’ of sidewalk which he had asked for but didn’t know he had to pay for.

A motion by Astleford seconded by Larson to not charge for the second sewer service if Mr. Nelson would sign a statement saying he would not develop his lot, also don’t put in the 90’ of sidewalk.

After discussion the vote was Astleford, Zimmerman. Larson Ayes, Emerson Hagemann Nay.

A Letter was received from Jan Kapaun stating the entire city should pay for the projects.

A motion by Emerson seconded by Hagemann to leave assessments as presented.

After discussion the vote was all ayes.

Carol Lang sent a objection letter but asked council to withdraw her objection.

Julia Didier sent a letter stating the projects should be paid by everyone.

A motion by Hagemann seconded by Emerson to leave assessments as presented.

After discussion the vote was all ayes.

Dale Serger submitted a letter stating objection to his assessments.

Mr. Klemenhagen stated the city will need an easement from Mr. Serger for the road work and suggested the council review his assessment and easement needed before finalizing his assessment.

A motion by Emerson seconded by Hageman to review Mr. Serger assessment and easement needed before finalizing his assessment.

After discussion the vote was All Ayes.

LaRayne Johnson submitted an objection letter regarding curb and gutter. She was in attendance and withdrew her objection.

The Osakis Public School stated the assessments were fine except for the sanitary sewer service charge to the tennis courts.

A motion by Astleford seconded by Emerson to eliminate the service charge to the tennis court.

After discussion the vote was Astleford, Emerson, Zimmerman, Hagemann Aye, Larson

Nay.

After reviewing Evelyn Vogels assessment the sanitary sewer main was figured on 158’ and should have been figured on 79’.

A motion by Emerson seconded by Hagemann to correct this assessment.

After discussion the vote was All Ayes.

Mr. Ken Wittrock asked if he had to have a sewer service line into the lot where his garage is, he is already paying for one to his house.

A motion by Hagemann seconded by Larson to review before finalizing assessments.

After discussion the vote was all ayes.

The Clerk stated Dana Hetland’s assessment was changed to have the sanitary sewer service and main be charged on the highway project and subtracted from the Oak, Pike Project.

A motion by Hagemann seconded by Emerson to approve this change.

After discussion the vote was all ayes.

Councilmember Larson asked if we could not charge interest on the assessments until completion of the project. This would cost the city approximately $36,000.00.

A motion by Emerson seconded by Hagemann to adopt the assessment roll as amended. The assessment will be added to taxes for the payable 2003 taxes however the interest will not start until the project is complete. This would be pending Douglas County Auditors approval.

After discussion the vote was all ayes.

A motion by Hagemann seconded by Astleford to adjourn. All Ayes.

Meeting adjourned at 10:00 pm.
